Terms of Service

1. Definitions and Interpretation

• "Platform": Refers to the OpiniYield web application, mobile interfaces, regional dashboards, and associated backend infrastructure.
• "User" or "Consumer": Any individual who registers an account, completes surveys, views video briefs, or interacts with the platform.
• "Points": Internal cryptographic or numerical metrics credited to a user's account dashboard upon verified survey completion or cryptocurrency deposit, which can be converted for payout requests.
• "OxaPay Gateway": The third-party crypto payment and payout infrastructure utilized to handle secure blockchain deposits and USDT (ERC-20) withdrawals.

2. Eligibility and Account Registration

To use OpiniYield, you must be at least 18 years of age (or the legal age of majority in your state, province, or country of residence). By registering, you warrant that all information provided—including your legal name, regional location, and email address—is accurate and up to date.

Only one account is permitted per natural person. Creating multiple accounts, operating under pseudonyms, or using virtual private networks (VPNs), proxy servers, or Tor networks to disguise your geographic location is strictly prohibited and constitutes a material breach of this agreement.

3. Regional Operations and Management

OpiniYield operates across multiple regional jurisdictions within North America and globally. Regional managers oversee task distribution, dispute resolution, and localized survey relevancy. Users agree to abide by any state-specific or regional guidelines established by their assigned administrative zone.

4. Anti-Fraud, Bots, and Platform Integrity

To maintain the highest level of market research validity for corporate sponsors, OpiniYield deploys an automated Anti-Fraud and Threat Awareness engine. Both parties agree to protect platform integrity through the following rules:

• Velocity and Speed Checks: Surveys completed faster than permissible cognitive thresholds (e.g., rapid clicking or random guessing) are automatically flagged as invalid, withholding rewards.
• Honeypot Traps & Automation: Any automated script, web scraper, bot, or automated clicking tool interacting with our forms will trigger immediate account suspension.
• Text Quality Scoring: Open-ended responses containing keyboard mashing, spam characters, or duplicated text strings will lead to task rejection and potential point penalties.
• Strike System: Users violating engagement guidelines accumulate compliance strikes. Accumulating three (3) active strikes results in permanent account termination and forfeiture of unpaid balances.

5. Points, Cryptocurrency Deposits, and OxaPay Integration

When enabled by platform administrators via feature flags, users may fund their internal point balance by making cryptocurrency deposits through the OxaPay gateway.

Deposits are final once verified on the public blockchain ledger. OpiniYield acts solely as a platform provider and is not liable for blockchain transaction delays, network congestion, incorrect wallet routing, or third-party token depegging events.

6. USDT (ERC-20) Withdrawals, Gas Fees, and Processing

Users may request to withdraw accumulated earnings in USDT (ERC-20) subject to the following conditions:

• Gas Fee Transparency: Ethereum network transaction gas fees are calculated dynamically at the time of withdrawal and deducted or factored into the net payout amount.
• Wallet Responsibility: Users are entirely responsible for providing an accurate, compatible ERC-20 receiving address. OpiniYield bears no responsibility for funds sent to incorrect, uncompatible, or locked smart contract addresses.
• Withdrawal Restrictions: Accounts flagged under routine security reviews, compliance audits, or fraud investigations may have withdrawal privileges temporarily restricted pending manual verification.

7. Consumer Protections and Privacy Rights

We respect your privacy and adhere to applicable data privacy standards, including provisions aligned with the California Consumer Privacy Act (CCPA) and General Data Protection Regulation (GDPR) frameworks. We will never sell your personally identifiable survey responses to unauthorized third parties. Personal data collected is used strictly for market research aggregation, anti-fraud verification, and account security.

8. Account Suspension, Banning, and Appeals

OpiniYield reserves the right to suspend, restrict, or permanently ban any user account at our sole discretion if we detect suspicious activity, policy violations, or threats to system security. Users who believe their account was restricted in error may submit an appeal through our Contact Us portal for manual review by regional supervisors.

9. Limitation of Liability and Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by United States federal and state law, OpiniYield, its founders, regional managers, affiliates, and technology partners shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from platform downtime, blockchain failures, data loss, or unauthorized access to user accounts.

10. Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. Notice of significant modifications will be posted prominently on the platform. Continued use of OpiniYield following any changes constitutes your binding acceptance of the revised terms.
